Most important issue: National research on the courts reveals that procedural fairness, not case outcomes, is the critical element in public perception and satisfaction with the court system. Even when parties lose, they are much more likely to find the decision legitimate if they believe the process was fair. When court budgets are being cut and calendars are filled with increasingly complex cases involving social issues-like chemical dependency and mental health issues-interacting with legal problems, case volume cannot be an excuse for deemphasizing best practice procedural fairness. To do so puts the legitimacy of the court system at risk.
